Should you join a dating app during a pending divorce?

It is natural to want to move on to a new romantic interest when you file for divorce. However, divorce can take a long time, especially if you and your spouse have a lot of expensive assets to divide. Additionally, California requires a six-month waiting period before dissolving a marriage entirely. No matter what, you will need to wait a minimum of six months before finalizing the divorce. 

A lot of people are hesitant to find a new partner, even though they want emotional support during this time. You are certainly within your rights to date when you want to after filing for divorce, but you want to keep one important factor in mind. 

Dating will not affect your right to spousal support

You should know that California is a no-fault divorce state. That means couples do not need a reason to separate. They can simply state the divorce is due to irreconcilable differences, so your spouse cannot try to link your new romantic interest to any sort of infidelity. Your spouse cannot work you dating into making adjustments to spousal support or property division. Fault and blame do not come into play. 

Dating could affect child custody

However, you still may want to think twice before entering a serious relationship. Your spouse may not like you dating someone so soon. As a result, he or she may try to sabotage the divorce proceedings, dragging them out to spite you. Additionally, you need to be aware of how dating someone new could impact child custody. For example, your spouse could try to dig up dirt on your new partner. If there is anything unsavory there, then your spouse could try to limit the amount of time you see your children. Anyone with children may want to wait until finalizing the divorce before joining a dating app.
